These Terms and Conditions govern your use of the MLNU website, online services and related customer transactions.

1. About These Terms

These Terms and Conditions govern access to and use of the MLNU website, related online services and customer-facing transactions operated by MLNU.

By accessing this website, using its services or placing an order through the MLNU ordering platform, you acknowledge that you have read and understood these Terms and Conditions.

These Terms are intended to operate together with MLNU's applicable Privacy Policy, Shipping and Delivery Policy, Returns and Refunds Policy and any other specific terms applicable to a particular product, service or transaction.

Where a mandatory legal right applies, that legal right takes precedence over any inconsistent provision in these Terms.

2. MLNU and Nordens Ultimate

MLNU is the trading name and business-building and operating platform operated by:

JA Moolman, a sole proprietor trading as MLNU

MLNU administers the customer-facing ordering process, customer administration, fulfilment, returns, refunds, customer support and related operating processes, subject to applicable law.

Nordens Bioscience Technologies (Pty) Ltd, trading as Nordens Ultimate, is the product manufacturer / upstream supplier.

MLNU and Nordens Ultimate are therefore distinct parties with different roles. References to MLNU on this website should not be interpreted as stating that MLNU and Nordens Ultimate are the same legal entity.

  • to attempt to gain unauthorised access to systems, accounts or information;
  • to submit false, misleading or fraudulent information;
  • to impersonate another person or business; or
  • in a manner that could damage, disable, overburden or impair the website or related systems.

5. Product Information

MLNU provides product information for general identification, ordering and customer-information purposes.

Product information, descriptions, formats, packaging and availability may change from time to time.

Where product-specific instructions, dosage information, warnings or approved product information are applicable, customers should refer to the current product label, packaging and approved product information supplied with the product.

Nothing on this website should be interpreted as medical, diagnostic or individual healthcare advice.

MLNU does not authorise unsupported claims that a product diagnoses, treats, cures, prevents or reverses a disease or medical condition.

Product names and general product descriptions do not, by themselves, constitute a guarantee of a particular health outcome.

6. Product Orders

Products may be ordered through the MLNU online ordering platform or through an authorised process supported by an Independent Business Builder.

A customer may complete an order independently or may authorise an Independent Business Builder to assist with registration, order capture or other aspects of the ordering process.

The customer remains responsible for checking and approving:

  • their name and contact information;
  • selected products and quantities;
  • delivery address;
  • applicable price and delivery charges;
  • payment details; and
  • relevant product information and instructions.

7. Order Acceptance

Submission of an order constitutes a request to purchase the selected products. An order is subject to acceptance, successful payment or payment verification where applicable, product availability and other applicable transaction controls.

MLNU may contact a customer where additional information is reasonably required to verify or process an order.

MLNU may decline, suspend or cancel an order where there is a reasonable basis to believe that the transaction contains inaccurate information, is fraudulent, cannot be fulfilled, or would result in a violation of applicable law or MLNU's controlled operating requirements.

8. Pricing

Product prices displayed through the applicable MLNU ordering system are the prices applicable to the relevant customer transaction at the time of ordering, subject to any clearly disclosed terms, charges or corrections.

MLNU may change product prices from time to time. A price change will not retrospectively alter a completed transaction that has already been accepted, except where correction is required because of an obvious error or another lawful reason.

Applicable delivery charges, transaction charges or other separately disclosed charges will be identified through the relevant ordering process.

9. Payment

Payment must be made using a payment method made available through the applicable MLNU ordering process.

Where an Independent Business Builder assists a customer with payment collection through an authorised process, the Business Builder acts only within the authority provided by MLNU for that transaction.

The Business Builder does not acquire ownership of the products, set an independent resale price or enter into a separate sale of the products with the customer.

MLNU remains responsible for the customer order, payment processing, packaging, dispatch, returns, refunds and customer support, subject to applicable law.

10. Delivery

Products are delivered using the delivery options made available through the MLNU ordering process.

Delivery times may vary depending on the delivery method, destination, product availability, payment confirmation, courier operations and circumstances outside MLNU's reasonable control.

Customers are responsible for providing an accurate and complete delivery address and appropriate contact details.

A separate Shipping and Delivery Policy forms part of the customer-facing terms applicable to product deliveries.

11. Inspection on Delivery

Customers should inspect delivered products within a reasonable period and contact MLNU promptly if a product appears damaged, incorrect, incomplete or materially different from what was ordered.

A customer should retain relevant order information, photographs, packaging, batch information and delivery evidence where these may assist MLNU in investigating a problem.

12. Returns, Refunds and Consumer Rights

Nothing in these Terms limits, excludes or overrides any mandatory consumer right or remedy available under the South African Consumer Protection Act 68 of 2008 ("CPA") or any other applicable law.

The applicable return treatment depends on the reason for the return.

MLNU distinguishes between:

  • statutory returns and remedies;
  • direct-marketing cancellations where applicable;
  • voluntary change-of-mind returns; and
  • personal-use purchases by Independent Business Builders.

The detailed return and refund rules are contained in the current MLNU Returns and Refunds Policy.

13. Defective, Unsafe or Poor-Quality Products

Where a product is defective, unsafe or otherwise subject to a statutory remedy, MLNU will assess and handle the claim in accordance with applicable law.

Where applicable law provides a customer with a lawful remedy or choice of remedy, MLNU will apply the remedy required or permitted by law.

Depending on the circumstances and applicable law, a remedy may include repair, replacement or refund.

MLNU will not apply the voluntary change-of-mind refund deduction to an accepted defect, safety or quality claim.

14. Incorrect, Incomplete or Misdescribed Orders

A customer should contact MLNU where:

  • the wrong product was supplied;
  • the wrong quantity was supplied;
  • the product differs materially from the order or description;
  • the product arrived damaged; or
  • the product does not meet a specific purpose communicated to MLNU and accepted by MLNU.

Where MLNU or its delivery provider is responsible, MLNU will provide an appropriate remedy in accordance with applicable law.

15. Voluntary Change-of-Mind Returns

Subject to applicable statutory rights, MLNU may accept a voluntary change-of-mind return requested within 30 calendar days after delivery.

This voluntary commercial return option may apply where a customer no longer wants a product or ordered the wrong product, provided that the applicable return conditions are satisfied.

To qualify for an approved voluntary change-of-mind return, the product must generally:

  • be unused;
  • be unopened;
  • have all original packaging, labels and seals intact;
  • be undamaged and uncontaminated;
  • have a clearly identifiable batch or lot number;
  • be within its expiry date;
  • have reasonable remaining shelf life;
  • have been stored according to the product instructions;
  • not have been altered, repackaged or tampered with;
  • be capable of being confirmed as legally and commercially re-sellable after inspection; and
  • be accompanied by valid proof of purchase.

Opened, used or unsealed health, wellness, ingestible, cosmetic or hygiene products will generally not qualify for a voluntary change-of-mind return where they cannot safely or lawfully be resold.

16. Voluntary Return Refund

If a voluntary change-of-mind return is approved after inspection, the refund will be calculated according to the applicable MLNU Returns and Refunds Policy.

The current controlled voluntary-return basis is:

90% of the original wholesale price paid for the returned product.

This voluntary commercial refund is not a substitute for or limitation of a statutory consumer remedy.

Original delivery charges, return delivery charges and separately disclosed charges are excluded from the voluntary refund unless applicable law requires otherwise.

17. Return Authorisation

Customers should not send products to MLNU before the return has been assessed and MLNU has issued the applicable return instructions.

Where the Return Authorisation process applies, MLNU will issue a Return Authorisation ("RA") number and the authorised return address or return instructions.

The authorised return address is controlled and is not necessarily the same as MLNU's operating address.

Customers should return only the products authorised by MLNU and should retain tracking and proof-of-delivery information where applicable.

18. Privacy and Personal Information

MLNU processes personal information in accordance with applicable privacy law, including the Protection of Personal Information Act 4 of 2013 ("POPIA").

Personal information may be processed for purposes including:

  • customer registration;
  • order processing;
  • payment administration;
  • product delivery;
  • customer support;
  • returns and refunds;
  • fraud prevention;
  • accounting and record keeping;
  • complaints and dispute resolution; and
  • compliance with legal obligations.

19. Customer Information Collected Through Business Builders

Where an Independent Business Builder assists a customer, the Business Builder must use only approved MLNU systems and processes for customer information.

Customer information must be collected only where reasonably required for the approved purpose and must be handled securely.

Business Builders may not sell, share or reuse customer information for unauthorised purposes.

Customer information must not be uploaded to personal AI tools, personal cloud storage or unauthorised customer databases.

20. Intellectual Property

Unless otherwise stated, the content and materials presented on this website, including text, graphics, logos, branding, layouts, images and other materials, are owned by or used under authority by MLNU or the relevant rights holder.

You may access and use website content for lawful personal and informational purposes.

You may not reproduce, modify, distribute, publish, sell, license or commercially exploit website content without appropriate permission, except where permitted by law.

MLNU branding and Nordens Ultimate branding must not be represented as belonging to another person or business.

21. Links to Other Websites and Services

This website may contain links to external websites, platforms or services, including the MLNU online shop and Business Builder platform.

External websites and services may have their own terms, privacy policies and operating conditions.

MLNU is not responsible for the content, availability, security or policies of an external website except to the extent required by applicable law.

22. Business Builder Opportunity

MLNU may provide information about an opportunity to operate as an independent Business Builder.

The Business Builder relationship is separate from the customer purchase relationship.

A Business Builder operates an independent business and is not an employee of MLNU.

The Business Builder determines their own working hours, business activities, prospecting methods and ordinary business expenses, subject to lawful MLNU requirements concerning consumer protection, product representation, privacy, fraud prevention, transaction integrity and other legal or operational controls.

23. No Guaranteed Income

Nothing on this website guarantees that a person will earn income through the MLNU Business Builder opportunity.

Compensation depends on factors including genuine customer demand, verified retail sales, applicable qualification requirements, the activity of other Business Builders, transaction verification, returns and reversals and the rules of the applicable Compensation Plan.

Recruitment or sign-up by itself does not create compensation.

Personal Purchases by Business Builders are not customer sales and do not constitute Verified Sales.

24. Customer and Business Builder Distinction

A customer purchasing products for personal use is not automatically a Business Builder.

An Independent Business Builder may purchase products for their own personal use, but such purchases are treated as personal-use purchases and not as resale inventory.

Business Builders are not required or expected to maintain inventory or purchase products for resale under the current MLNU business model.

25. Website Availability

MLNU aims to keep the website and related services available, but does not guarantee that the website will always be available, uninterrupted or error-free.

Availability may be affected by maintenance, updates, technical failures, telecommunications problems, hosting interruptions, security incidents or circumstances outside MLNU's reasonable control.

26. Accuracy of Information

MLNU aims to keep website information reasonably accurate and current.

Product availability, descriptions, pricing, delivery arrangements and other information may change.

Where an obvious error appears on the website, MLNU may correct the error and, where applicable, contact affected customers regarding the transaction.

27. Fraud and Transaction Integrity

MLNU may implement reasonable controls to detect and prevent fraudulent, duplicate, fictitious or otherwise invalid transactions.

Customers and Business Builders must provide accurate information and must not attempt to manipulate orders, customer records, payment processes or other transaction information.

28. Limitation of Liability

Nothing in these Terms excludes, restricts or limits any liability, right or remedy that cannot lawfully be excluded, restricted or limited under applicable law.

Subject to that limitation, MLNU will not be responsible for loss arising solely from circumstances outside MLNU's reasonable control, including third-party platform outages, telecommunications failures, courier delays or other external events, except to the extent that applicable law provides otherwise.

Nothing in this section affects a customer's statutory rights concerning products, refunds, defective goods, consumer protection or other mandatory legal remedies.

29. Changes to These Terms

MLNU may update these Terms and Conditions from time to time to reflect changes in the website, products, services, operating processes or applicable legal requirements.

The current version published on this website will apply to future website use and transactions from its effective date, subject to applicable law and any contractual requirements concerning notice or acceptance.

A material change affecting an existing contractual relationship will be handled in accordance with the applicable agreement and legal requirements.

30. Governing Law

These Terms and Conditions are intended to be governed by the laws of the Republic of South Africa.

Mandatory rights and protections provided by applicable South African law remain applicable regardless of any provision of these Terms.

31. Complaints and Disputes

32. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated to the extent necessary as severed or modified without affecting the remaining provisions, subject to applicable law.

33. Entire Terms

These Terms and Conditions, together with the applicable policies and specific transaction terms referred to in them, form the website's customer-facing terms for the matters covered by these documents.

Specific product, delivery, returns, privacy or Business Builder terms may apply separately where expressly stated.

Where two MLNU documents address the same matter and contain different rules, the applicable legal requirements and the relevant controlled policy or contractual document will take precedence according to the applicable document hierarchy.
